North Yorkshire police officer charged with gross misconduct after sex assault

A North Yorkshire Police officer has been charged with gross misconduct after being convicted of sexual assault.

If found guilty at a misconduct hearing, PC 383 Joe McCabe could face the sack.

The hearing, chaired by Chief Constable Lisa Winward, is due to take place on Friday, 28 April at the force HQ in Northallerton.

It follows PC McCabe being convicted of sexual assault at York Magistrates’ Court.

The officer attended a wedding while off duty on 24 August 2021, and had agreed to share a hotel room with a woman at the Travelodge, Scotch Corner.

He touched the woman without her consent on 25 August while in the hotel room.

On 31 March, magistrates gave McCabe a six month prison sentence suspended for two years, and ordered him to pay £620 court costs and a £128 victim surcharge.

He was also required to attend the sexual offending group work programme, a 20 day rehabilitation activity requirement and alcohol absence monitoring requirement.

McCabe was issued with a three-year restraining order which prohibits him from contacting his victim and bars him from attending Harrogate Police Station unless to report a crime.

Now he faces this police misconduct charge: “It is alleged that the conduct breaches the standards of professional behaviour in respect of Authority, Respect and Courtesy and Discreditable Conduct.

“The conduct amounts to criminal conduct and is so serious that it amounts to gross misconduct.”

The charges come weeks after two York police officers were sacked for ‘appalling and repulsive’ racist WhatsApp messages.

Detective Constable 1911 Danielle Kirby and Police Constable 225 James Mills were both dismissed for gross misconduct at a police misconduct hearing last month.
